Franck Cine of Haitel goes to International Criminal Court for Martelly Preval

Complaints from Franck Cine were filed against Haitian Prime Minister Laurent Lamothe and Presidents Rene Preval and Michel Martelly with International Criminal Court by Haitel's CEO Frank Cine's lawyers. The aforementioned figures were charged with confiscation of property, illegal prosecution, torture, unlawful detention and unjust arrest towards Haitel's asset auction sale as well as towards Cine family.

Attorney Guy Lewis who is the head of Lewis & Tein Law firm, sent a letter on 8th May, 2013 to Ms. Fatou Bensouda who is the prosecutor of International Criminal Court in The Hague. The letter requested an immediate investigation into the charges against Rene Preval, Michel Martelly, Laurent Lamothe and other government officials.

It the letter, Guy Lewis requested the court for investigation of the case and prosecution of those responsible in accordance with Rome Statute's Article 15. It is worth mentioning that Rome Statute is not ratified in Republic of Haiti though the country has signed the Statute.

The lawyers further requested that Arbitration Court of Bermuda be invoked for making decisions in the dispute between the Haitian Government and Haitel. The Arbitration Court of Bermuda was the statute's designated tribunal that created Haitel.

Attorney Guy Lewis sent another letter to Jean Renél Sanon, the Minister of Justice. The letter asked for a proper investigation against Rene Preval, Michel Martelly and Laurent Lamothe. The dossier of Haitel has changed with these letters being submitted to the aforementioned authorities. According to sources, the Haitian leaders will not be forced to respond with the time frames prescribed by Law and that the methods applied by Haitian leaders to bypass law will no longer apply to these jurisdictions.
